General Terms and Conditions of Sale

Racespec is an online store specializing in the sale of components and accessories for motorcycles and their users, owned by Racespec Motos e Acessorios Lda, with its headquarters in Zona industrial de Travassô, 3750-753 Águeda. Racespec sells its products via the Internet (website or e-mail), by telephone or in its physical store.

1. Object
These General Conditions are presented in order to define the terms of sale between Racespec and its customers defined below. Any natural or legal person who places an order on www.racespec.pt, whether a private customer or not, becomes a customer under these general terms and conditions.

1.1. Field of application
These General Terms and Conditions of Sale govern the sale of products on the www.racespec.pt website on the day the order is validated. They apply whether the order was placed online, by e-mail, by telephone or in person.

1.2. Customer Agreement
The fact that the customer validates their order automatically means that they expressly accept these General Terms and Conditions of Sale. These Conditions apply to the exclusion of all other conditions, unless agreed by both parties. Purchases by e-mail, telephone, fax or post also imply acceptance of these terms and conditions. You can read them directly on our website. They can also be sent by e-mail or post at the customer's request.

1.3. Modification of the General Conditions of Sale
Racespec reserves the right to change the conditions of use or other regulations published on our website without prior notice. You should therefore consult the conditions of use regularly, as continued use of the website implies unreserved acceptance of the changes made to them and submission to the latest version. The version of this regulation does not have a precise date, orders are therefore managed by the General Conditions in use and therefore in force on the date of the order.

1.4. Product features
Racespec strives to present the essential product features described by the manufacturers as accurately as possible. Confirmation of technical data is always possible by contacting the manufacturer directly. The products on offer comply with the European legislation in force and the standards applicable in Europe.

1.5. User manual
Racespec endeavors to provide the user manual in the language of the consumer in paper format wherever possible. There are, unfortunately, situations in which it may not be provided on paper, but only in computerized form or downloaded directly from the Internet.

1.6. Prices

1.6.1. The sale prices indicated on the website are in Euros, with taxes and fees included in the retail prices.

1.6.2. If our suppliers' prices change in any way, the prices shown on the site are therefore liable to change at any time.

1.6.3. All the prices indicated are correct unless there has been an error in entering the data. If an order is placed for an item with an incorrect price, we reserve the right to cancel the order and refund the amount paid.

2. Value Added Tax (VAT)

2.1. Applicability
VAT applies to sales made to residents of the European Union. It does not apply to non-Portuguese companies in the European Union with an intra-Community VAT number. VAT does not apply to export sales (countries outside the European Union). The invoice accompanies the goods and certifies that the VAT has been paid.

2.2. Rates
All prices include VAT at the rate of 23%.

3. Orders

3.1. Making an order
When the customer places their order via the website, they must fill in the form provided. Before validating the order, you should re-read the form to confirm the details. Racespec is not responsible for errors in the sending of e-mails, nor for errors in the sending of orders due to incorrectly filled in forms.

3.2. Order confirmation
Confirmation of the order is sent to the customer by automatic e-mail, provided that the e-mail address provided does not contain any errors.

3.3. Order cancellation
Any customer can cancel their order at any time, unless it has been invoiced. In this case, if the customer does not really want the products ordered, they must accept the order and return it at their own expense, i.e. return it unopened, mentioning "order refused". If the customer has ordered via the website, they can cancel their order by phone, fax or e-mail. If the customer refuses delivery of the order, the initial shipping and return costs will be deducted from the amount of the refund.

3.4. Product availability
Our product offers and prices are valid as long as they are visible on our website and within the limits of available stock. Further information can be obtained by telephone or e-mail. If Racespec is unable, for whatever reason, to obtain a product from the suppliers within the period indicated, the customer will be informed of the status of the order by e-mail or telephone. In this way, the customer can choose to cancel their order or choose another available product. Racespec reserves the right to refuse an order.

4. Payment

4.1. Payment Method
Customers can pay by bank transfer, bank transfer or MBWay. In the case of products that are only available on request, an amount may be requested to signify the order.

4.2. Lack of payment
Racespec reserves the right to refuse delivery or fulfill an order from a customer who has not paid in full or in part for a product ordered. All payments requested must be made within 3 business days of placing the order. After this period, the order will be canceled.

4.3. Property reservation
Racespec owns the products until they are paid for in full by the customer.

5. Shipping fees

5.1. Mainland Portugal
For orders up to 150€, up to a limit of 30kg, a flat-rate contribution of 6.50€ will be charged for shipping costs. If the weight exceeds 30 kg, shipping will be calculated after the order has been placed. Do not pay until our services have calculated the cost of shipping.

5.2. Madeira and Azores Islands
For orders up to 150€, up to a limit of 2kg, a flat-rate contribution of 6.50€ will be charged for shipping costs. Shipping costs will be calculated after the order has been placed. Do not pay until our services have calculated the cost of shipping.

6. Invoice
The customer's online order form does not serve as an invoice. Regardless of the type of order, the customer will receive the invoice together with the goods at the time of delivery.

7. Deadlines

7.1. Order preparation deadlines
Internet orders are processed on a first-come, first-served basis. The processing deadline for an order varies depending on the availability of each product.

7.2. Shipping deadlines
Shipping deadlines for goods are indicated by the carrier. These are sent to the customer on an indicative basis, in business days, and also depend on the accuracy of the address provided by the customer on the date of the order as well as their availability to receive the order. Failure by the carrier to meet these deadlines shall in no way compromise Racespec's liability. These deadlines are indicated to the customer when the goods are dispatched.

8. Dispatch

8.1 Packaging
The products to be shipped are packaged so that they arrive at the place of delivery in perfect condition, always taking customer satisfaction into account.

8.2 Confirmation
If the customer has placed their order on the website, an automatic order confirmation e-mail will be sent.

9. Delivery

9.1. Delivery location
Orders are delivered to the delivery address indicated by the customer on the order form.

9.2. Absence on the day of delivery
You will be informed of the expected delivery date of your order. You should indicate a delivery address where someone is always present between 9h and 18h, such as at work. If delivery does not take place, you will be informed of the date and time the courier was present. A new delivery attempt will be made on the next business day.

9.3. Delivery deadlines
Estimated delivery time varies between 1 and 30 days, for more information please contact our services.

9.4. Loss of orders
In this case, Racespec is obliged to respect the deadlines imposed by the carrier regarding the declaration of loss and the reimbursement of the shipment. Therefore, the customer must also wait for these deadlines:

You have a maximum of 30 business days from receiving the e-mail confirming that your order has been sent to declare it lost to Racespec.pt. No appeal will be accepted after this deadline.
On the other hand, if the customer declares that the order has been lost within the established time limit, Racespec will have to open an appeal procedure. In this case, Racespec.pt may ask the customer for the documents needed to open an appeal. The latter must provide the requested data as quickly as possible.
Lastly, the carrier provides final answers to the inquiries within a period of between 1 and 3 weeks. There may be two types of situations: either the order is recovered and sent back to the customer in accordance with normal procedures, or the order is declared lost by the carrier and Racespec informs the customer to resend the order or the invoiced amount will be refunded, depending on the customer's preference.

9.5. Receiving the order
We recommend that all orders delivered be checked and monitored, and that the customer make any notes on the condition of the product on the carrier's product guide in the event of partial or total deterioration. Without the appropriate notes from the customer, the order cannot be challenged at a later date by Racespec. Verification of the product's condition is deemed to have been carried out once the delivery note has been signed. If the product is damaged, please take a picture of it and send it to us at encomendas@racespec.pt within 24 hours so that we can arrange transport insurance.

9.6. Order content error
Upon the receiving of the order by the customer, the latter must inform Racespec by telephone or e-mail of any claim of non-conformity of the products in type, quality or quantity in comparison with the data of the order placed. Complaints of non-conformity must be made within 24 hours of delivery of the order. Appeals not made in accordance with the rules set out above and within the time limits indicated will not be accepted by Racespec.

9.7. Strikes or force majeure events
In the event of a carrier strike or other exceptional event that delays or prevents delivery of the order, Racespec will inform the customer of the delivery status.

10. Returns

10.1. General returns procedures and conditions

10.1.1. Conditions
The customer has the right to return the purchase within a maximum of 15 days from the date of delivery of the good/order, with the exception of personalized items or items only available on prior order, for which no return or exchange will be accepted. If the consumer chooses to request a refund, this will be done within 30 days of receiving the product from Racespec and through a credit to be deducted from future purchases. If you wish to make a return, you must first contact us by e-mail at encomendas@racespec.pt, by telephone on +351 234 669 146 or you can come to our facilities with the purchase invoice and tell us if you want to exchange the goods or if you want a credit.

10.1.2. Package condition
Returned items must be in perfect condition, complete and properly packaged in the original packaging and without any signs of actual use.
In the event of withdrawal or customer error, the shipping and return costs will be the sole responsibility of the customer.

10.1.3. Internal error
Racespec is responsible for the return and reshipment costs if there is an internal error and the product sent does not correspond to the order. If you wish to exchange your item for a different one, Racespec will be responsible for the return postage and the new shipment.

10.1.4. Defects of origin
Racespec is responsible for the return and reshipment costs if the product is defective. In this case, the exchange must be for the same item. If you want to exchange the item for a different one, the customer will be responsible for the return postage and the new shipment.

10.1.5. Transport damage
Racespec will not be responsible for return or reshipment costs if the package has been damaged in transit. In this case, the exchange must be for the same item. If you want to exchange the item for a different one, the customer will be responsible for the return postage and the new shipment.

Important note: We recommend that you pay attention to the external condition of the packaging, as this may reflect possible damage to the product. At the time of delivery and in the presence of the carrier, you must check the condition of the product before signing the waybill and thus accepting the order. If the product is damaged, please take a picture of it and send it to us at encomendas@racespec.pt within 24 hours so that we can arrange transport insurance.

Verification of the product's condition is deemed to have taken place once the waybill has been signed.

10.1.6. Any package received at our premises without identification of the sender or sent collect will not be accepted.

10.1.7. Sizes and colors
The items on this site have sizes and colors that are as close as possible to the genuine thing, but we remind you that in some cases they may not correspond 100% to reality. For specific cases, please check all information with the technical department at encomendas@racespec.pt before ordering, as returns for technical reasons will be the sole responsibility of the customer.

10.1.8. Customized goods
Returns, cancellations or refunds do not apply to customized goods, as provided for by law:
"Supply of goods produced or ordered according to consumer specifications or manifestly customized cannot be returned."

10.1.9. Return shipping
In the event of withdrawal or customer error, the shipping and return costs will be the sole responsibility of the customer.

10.2. Decree-laws
Information on the consumer's (private customer) right to withdraw from the contract is described in detail in Decree-Law 143/2001 and Decree-Law 82/2008. Regarding the right to terminate the contract by Companies, Institutions, Self Employed Professionals and Individual Entrepreneurs, the general law of the Portuguese Civil Code applies, namely the rules set out in Decree-Law 67/2003.

12 - Law and Jurisdiction
These general conditions are governed by Portuguese law. All disputes arising from the interpretation or execution of this agreement shall be settled by the District Court of Baixo Vouga, with express waiver of any other.

Online Shop - Motorcycles, Quad Bikes and Accessories

RACESPEC Motos, a dealership for KTM, Husqvarna, Gas Gas and CFMOTO in the Aveiro district, is a company based in Águeda. It is dedicated to the sale, repair and preparation of motorcycles and quad bikes, including accessories from everyday use to high-level competition.

Since it began operating in May 2010, it has grown and expanded rapidly, allowing it to develop a well-prepared production structure to meet the needs of each client. It currently has a technical staff of 3 permanent associates with the appropriate qualifications and experience, duly supported by a modern logistical and mechanical structure.
