General Conditions of Sale
Racespec is an online store specialized in the sale of components and accessories for motorcycles and their users, owned by Racespec Motos e Acessorios Lda, headquartered at Zona Industrial de Travassô, 3750-753 Águeda. Racespec sells its products via the Internet (website or email), by telephone, or in its physical store.
1. Purpose
These General Conditions are presented in order to define the terms of sale between Racespec and its customers as defined below. Any natural or legal person who places an order on the website www.racespec.pt, whether a private customer or not, shall be considered a customer under these General Conditions.
1.1 Scope
These General Conditions of Sale govern the sale of products on the website www.racespec.pt on the day the order is validated. They apply whether the order has been placed via the Internet, email, telephone, or in person.
1.2 Customer Acceptance
The act of the customer validating their order automatically constitutes express acceptance of these General Conditions of Sale. These Conditions apply to the exclusion of all others, unless otherwise agreed in writing by both parties. Purchases made via email, telephone, fax, or postal mail also imply acceptance of these Conditions. They may be read directly on our website and may also be sent by email or post at the customer’s request.
1.3 Modification of the General Conditions of Sale
Racespec reserves the right to change, without prior notice, the conditions of use or other regulations published on our website. Therefore, you should regularly consult the conditions of use, as continued use of the website implies unconditional acceptance of any changes made and submission to the most recent version. This regulation does not have a specific date, and orders are therefore governed by the General Conditions in use and in force at the time of the order.
1.4 Product Characteristics
Racespec strives to present, as accurately as possible, the essential characteristics of the products as described by the manufacturers. Technical data can always be confirmed by contacting the manufacturer directly. The products offered comply with current European legislation and applicable standards in Europe.
1.5 User Manual
Racespec strives to provide, whenever possible, the user manual in the consumer’s language in paper format. However, there are situations where it may not be provided in paper format and may only be available in digital format or for download directly from the Internet.
1.6 Prices
1.6.1 The selling prices indicated on the website are in Euros, with taxes included in the public sale price.
1.6.2 If our suppliers’ prices undergo any changes, the prices shown on the website may be changed at any time accordingly.
1.6.3 All prices indicated are correct except in the case of data entry errors. If an order is placed for an item with an incorrect price, we reserve the right to cancel the order and refund the amount paid to the customer.
2. Value Added Tax (VAT)
2.1 Application
VAT applies to sales concluded with residents of the European Union. It does not apply to non-Portuguese companies within the European Union that have an intra-community VAT number. VAT does not apply to export sales (countries outside the European Union). The invoice accompanies the goods and certifies that VAT has been paid.
2.2 Rates
All prices include VAT at the rate of 23%.
3. Orders
3.1 Placing an Order
When placing an order through the website, the customer must complete the form provided. Before validating the order, the customer should review the form to confirm the data. Racespec is not responsible for errors in sending emails or orders due to incorrectly completed forms.
3.2 Order Confirmation
Order confirmation is sent to the customer automatically by email, provided that the email address indicated contains no errors.
3.3 Order Cancellation
Any customer may cancel their order at any time, unless it has already been invoiced. In this case, if the customer does not wish to keep the ordered products, they must accept the delivery and return it at their own expense, unopened, indicating “order refused.” If the order was placed via the website, it may be cancelled by telephone, fax, or email. If the customer refuses delivery, the initial shipping and return costs will be deducted from the refund amount.
3.4 Product Availability
Our product offers and prices are valid as long as they are visible on our website and within the limits of available stock. Additional information may be provided by telephone or email. If Racespec is unable, for any reason, to obtain a product from suppliers within the indicated timeframe, the customer will be informed of the order status via email or telephone. The customer may then choose to cancel the order or select another available product. Racespec reserves the right to refuse any order.
4. Payment
4.1 Payment Method
The customer may pay via Multibanco reference or MBWay. In the case of products available only upon order, a deposit may be required.
4.2 Non-Payment
Racespec reserves the right to refuse delivery or fulfill an order from a customer who has not paid in full or in part for a requested product. All requested payments must be made within a maximum of 3 working days after placing the order. After this period, the order will be canceled.
4.3 Retention of Ownership
Racespec remains the owner of the products until full payment has been made by the customer.
5. Shipping Costs
5.1 Mainland Portugal
For orders up to €150 and up to 30kg, a fixed contribution of €6.50 is charged for shipping. If the weight exceeds 30kg, the shipping cost will be calculated after the order. Do not make payment until our services calculate the shipping cost.

Austria, Denmark, Italy and Sweden: €22.00
Belgium, Netherlands and Luxembourg: €18.00

If the weight exceeds 30 kg, the shipping cost will be calculated after the order is placed. Please do not make payment until our team has calculated the shipping cost.
6. Invoice
The order note made online by the customer does not serve as an invoice. Regardless of the type of order, the customer will receive the invoice together with the goods at the time of delivery.
7. Deadlines
7.1 Order Preparation Time
Orders placed via the Internet are processed in order of arrival. The processing time varies depending on product availability.
7.2 Transport Time
Transport times are indicated by the carrier. These are provided to the customer as an indication, in working days, and also depend on the accuracy of the address provided and the customer’s availability to receive the order. Failure by the carrier to meet these deadlines shall not in any case engage the responsibility of Racespec. These deadlines are communicated to the customer at the time of dispatch.
8. Shipping
8.1 Packaging
Products to be shipped are packaged and prepared so that they arrive at the delivery location in perfect condition, always with customer satisfaction in mind.
8.2 Confirmation
If the customer placed the order on the website, an automatic confirmation email will be sent.
9. Delivery
9.1 Delivery Address
Orders are delivered to the address provided by the customer in the order.
9.2 Absence on Delivery Day
You will be informed of the expected delivery date. You must provide a delivery address where someone is always present between 9:00 and 18:00, such as a workplace. If delivery is not completed, you will be informed of the date and time the carrier was present. A new delivery attempt will be made on the next working day.
9.3 Delivery Time

9.4 Loss of Orders
In this case, Racespec must comply with the deadlines imposed by the carrier regarding loss declarations and reimbursement. Therefore, the customer must also respect these deadlines:
The customer has a maximum of 30 working days from the receipt of the shipping confirmation email to declare the order lost to Racespec.pt. After this period, no claims will be accepted.
If the loss is declared within the deadline, Racespec will open a claim process. Racespec.pt may request documents necessary for opening the claim, which must be provided promptly.
Final responses from the carrier are given within 1 to 3 weeks. Two situations may occur: either the order is recovered and resent, or it is declared lost and the customer may choose between reshipment or a refund.
9.5 Receipt of Order
All delivered orders should be inspected. The customer must note any damage on the carrier’s delivery note. Without such notes, no claims will be accepted later. Once the delivery note is signed, the product is considered verified. If the product is damaged, please photograph it and send the image within 24 hours to encomendas@racespec.pt to activate transport insurance.
9.6 Incorrect Order Content
The customer must report any discrepancy in type, quality, or quantity within 24 hours of delivery. Claims not made according to these rules will not be accepted.
9.7 Strikes or Force Majeure
In the event of strikes or exceptional events delaying delivery, Racespec will inform the customer.
10. Returns (Right of Withdrawal)
10.1 Procedures and General Conditions
10.1.1 Conditions
The customer has the right to return the purchase within 15 days of delivery, except for personalized or made-to-order items, for which returns or exchanges are not accepted. Refunds are processed within 30 days as store credit for future purchases.
To initiate a return, contact us via email, phone, or in person with the invoice and indicate whether you want an exchange or credit.
10.1.2 Packaging Condition
Returned items must be in perfect condition, complete, and in original packaging, with no signs of use. Return shipping costs are the customer’s responsibility in case of withdrawal or error.
10.1.3 Internal Error
Racespec covers return and reshipping costs if the error is theirs.
10.1.4 Manufacturing Defects
Racespec covers return and reshipping costs if the product has defects. Exchanges must be for the same item. If exchanged for a different item, costs are the customer’s responsibility.
10.1.5 Damage in Transit
Racespec shall not be responsible for return and reshipping costs if the order was damaged during transport. In this case, the exchange must be made for the same item. If you wish to exchange for a different item, return and new shipping costs are the responsibility of the customer.
10.1.6
Any package received without sender identification or sent cash-on-delivery will not be accepted.
10.1.7 Sizes and Colors
Products are as close as possible to reality, but may not match 100%. For technical clarifications, contact us before ordering. Returns for technical reasons are the customer’s responsibility.
10.1.8 Personalized Goods
Returns, cancellations, or refunds do not apply to personalized goods:
“Supply of goods made according to consumer specifications or clearly personalized cannot be returned.”
10.1.9 Withdrawal Shipping Costs
Return shipping costs are the responsibility of the customer.
10.2 Legal Framework
The consumer’s right of withdrawal is governed by Decree-Law no. 143/2001 and Decree-Law no. 82/2008. For businesses, Portuguese Civil Code applies, namely Decree-Law 67/2003.

12. Law and Jurisdiction
These General Conditions are governed by Portuguese law. All disputes shall be settled by the Court of the Baixo Vouga District, with express waiver of any other jurisdiction.
